Privacy Policy
Theiss Institute of Health & Fitness (TIHF) has created, modified, owns, uses, offers for sale, or may offer for sale certain methods, technologies, products and/or equipment (collectively "the Information") that it deems proprietary and/or is protected by copyright, trademark, patent or service mark.
The Information gives TIHF an opportunity to obtain an advantage over its competitors who do not know, possess or use it. The Information has been developed by TIHF at great expenditure of time, money and labor; are valuable trade secrets of TIHF; are protected by civil and criminal law and their use and disclosure are carefully and continuously controlled and monitored by THIF.
As a participant of TIHF you have access to TIHF facilities and Information. TIHF is willing to permit release of Information to you only pursuant to the following terms:
You, on behalf of yourself, your affiliates, employees, contractors and agents, agree:
a) You will not at any time either disclose, distribute, publish, duplicate, transmit, sell, offer for sale, market or otherwise communicate any of the Information to any third party or permit any third party to examine or make copies of the Information to any third party or permit any third party to examine or make copies of the information that is in your possession or under your control by reason of your participant relationship with TIHF.
b) To treat the Information with at least the same care as that which you treat your own most confidential or proprietary Information. Your confidentiality and use obligations hereunder will survive any termination of your participant relationship with TIHF.
The provisions of Paragraph One hereof shall not apply with respect to any of the Information which is already publicly know; Information which subsequently becomes publicly known; Information which hereafter is lawfully received by you under no obligation of confidentiality; or information that was independently developed by you prior to the time of disclosure and without the use of information disclosed by TIHF.
Nothing in this Agreement obligates TIHF to disclose to you any of the Information. TIHF reserves the right to withhold any or all of such Information as it, in its sole discretion, deems appropriate.
This Agreement constitutes no waiver or license of any rights secured by any patent, trademark, copyright or service mark, which TIHF now owns or obtains in the future, nor shall your access to the Information be considered a waiver or license of any of TIHF rights to the information.
In recognition of the fact that irreparable injury will result to TIHF in the event of your breach of this Agreement, you agree that in such event TIHF shall be entitled, in addition to all other remedies and damages available, to an injunction to restrain the violation thereof by you, your affiliates, employees, contractors and agents, and all persons acting for you and with you, and that such injunction would be appropriate preliminary relief for any threatened violation of this Agreement.
In the event suit is brought on this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys' fees in addition to all other relief to which it is entitled. Venue of any such action shall be the appropriate Court.
If the above is acceptable, please indicate your assent by signing this letter at the place indicated below.
The Theiss Institute of Health and Fitness values its clinets and customers and respects their privacy. We collect client and customer information to validate you as a registered client. The Theiss Institute of Health and Fitness recognizes that it must maintain and use customer information responsibly. We do not sell or rent the information you provide to us online to third parties. However, we do share your information with third parties under certain circumstances in order to provide you with the best results from our programs and products possible.
We may collect personal information and credit card information for the purposes of validating client and customer accounts as well as processing orders. We do not share your credit card information with any third parties.
This policy describes the personal information we collect about you, why we collect it, how we use it and when we share it with third parties.
